Check out this link. They're profiting again on something that's free! We gotta email the buyer and point him/her to the DC hub and improve our karma a little.

Yeah, there's a surprising number of ebay auctions that only sell like a single Loveline appearance. I search eBay occasionally on the off chance there may be some episodes for sale that we don't have.

Only trouble with reporting sales of the show to Westwood One is, they may get curious and look around for other copyright infractions, and then shut us down too (us being people who share the show for free). That would be bad times.

No. There is a difference between what you do and what he does. You just back it up and put it online for your own purposes. He either records it and then resells it or takes someone else's recording and sells it. Either way he is the only person violating any copyrights..

What is really offensive is that the guy is only selling ONE episode! What a ripoff even if it was legal. I mean, couldn't most of us put together a couple of hundred episodes on a number of CD-ROM's or DVD's? THAT would be worth buying.

Not that I want to argue you into believing that we're doing something wrong, but technically, recording and distributing the show is a violation of Westwood One's copyright... whether or not you make money doing it; So in the eyes of the law its the same "crime" - Morally though, I say there is a huge difference between freely distributing a show to fellow fans (especially when its not commercially available), and selling copies of someone else's property for the express purpose of profit... Any person selling Loveline is evil.

I don't want to get into a discussion about it either, I'm just saying I believe that in the eys of the law there are no laws being broken when you record something and put it on the Internet for your own backup purposes. If people find the link and download it, that is then there problem.

It's kind of like how the RIAA sits on Kazaa all day and catches people sharing and downloading Britney Spears, Metallica, etc. They can't go after Kazaa because they can say something as simple as, say, they're just putting up a network to share text files but people end up sharing MP3s. It all goes back to the big VCR lawsuit. The judge ruled that the VCR is for personal use and users can't be sued for using their VCR. However people using their VCR for malicious or bootlegging intent will be punished by law.

I agree with you on morality and whatnot, but I'm just saying even as fans I don't think anyone's doing anything wrong even legally when they put the show up. However this person on eBay is violating federal/Westwood One copyright laws, eBay regulations and laws, and last he is hurting us as fans because frankly he's probably just on the DC hub downloading away and selling shows here and there for quick, easy, free money. Unacceptable.

And last, I'd like to say although every word I typed is true, I did see something on Fox News Channel a few weeks ago about a bill in congress thats trying to go after the networks that people use for their malicious practices. Now of course this was FNC, but they said theoretically if you send an email over Yahoo to someone about something illegal, the feds can sue the sender, Yahoo, and the person being emailed! So, essentially they would be able to sue SV, Dolland, and anyone using this forum for even talking about trading MP3s. One major example they used as how crazy it would be, they said if you have a 40gb iPod filled with MP3s, they could sue the iPod owner for over a billion dollars because they'd sue him for every song on there. Because its not on the CD the label released.

There was a lot of people yelling about it, and I haven't really looked into it but Shepard Smith seemed pretty scared that he could get sued for his iPod. So maybe we shoudl keep an eye out for this..

And last, I think even the lawyers for Westwood One have souls and they wouldn't sue the 50 fans on here who listen to Loveline word for word and send eachother MP3s. But they would love to sue the guy using Loveline and Nickelback's name to make money for himself.

At the very least we could try and contact eBay about the bootleg being against their policies.

All I got to say is that show better be in the same quality (bout 128kb) that is was broadcasted in, and there is close to no static. That person is truley NOT a fan of Loveline.

What does putting it on the Internet have to do with backup purposes? With the DC hub, the files are still on your computer, so there's no backup. Even with an FTP site, you could easily keep it private with a password, but instead the owners make the sites available to anyone. Unauthorized distribution is copyright infringement.

This wouldn't be the first Loveline web site to get a cease and desist letter, although in the previous case it wasn't over this issue.

Bottom line, we shouldn't do anything to attract corporate attention to us.

Whatever, I'm not a lawyer. If you can't comprehend that you're not distributing by having it on your PC or a web server (which is just another PC) then fine. However Unauthorized distribution means eBay, copying it to CDs and giving them out, selling them, whatever.

Having MP3s on your computer or uploading them to a web server FOR BACKUP PURPOSES is the reason none of us get cease & desist letters.

However it's the people who sell the recordings who do. And they also give us a bad name, so personally whenever I see someone selling Stern or Loveline I love to report it at least to eBay where most of them hawk their wares.

By the way, I bought the Cadet PC radio to record Loveline and it works great if for some reason you cannot record it off a stream. I was using to record off KROQ for a while before you ultra cool guys (I REALLY appreciate the work you guys do for us other fans) let us download it.
